Jussie Smollett's conviction in hoax attack overturned by state supreme court
The Illinois Supreme Court has thrown out former "Empire" actor Jussie Smollett's conviction for lying about a 2019 hate crime.
Smollett was found guilty in 2021 of faking a racist and homophobic attack and lying to the police. His lawyers said this violated his Fifth Amendment rights because, in 2019, Cook County State's Attorney Kim Foxx had already agreed to decrease the charges if Smollett paid $10,000 and did people service. A distinct prosecutor later charged him again, head to his trial and conviction.
In its decision, filed on Thursday, the court stated they are resolving a "question about the State's responsibility to honor the agreements it makes with defendants."

Jussie Smollett, the actor accused of staging a animosity crime hoax, has had his conviction overturned five years after he was first arrested.
In 2022, the Empire star was sentenced to 150 days in jail, and ordered to pay a fine of $145,000 (£110,000) for lying to the police about being the victim of a hate crime.
He was found guilty of five charges in December 2021 over his false reports of being attacked in Chicago in 2019.
Now judges in Illinois hold ruled that trial breached his rights and reversed the decision.

29 January 2019: The alleged incident takes place
Chicago police say they're investigating a suspected racist and homophobic attack of Jussie Smollett by two masked men which happened at about 02:00.
They say the star was punched in the face, had an "unknown chemical substance" poured on him and a rope wrapped around his neck.

One of the two brothers who claim actor Jussie Smollett paid them to pull off a fake attack took the stand on Wednesday. Smollett, 39, faces six counts of disorderly behavior and is accused of lying to police about the 2019 incident.
Smollett, who is Black and openly gay, told Chicago police that he was attacked by two masked men who yelled racist and homophobic slurs in January 2019, authorities said. Smollett claimed the men place a noose around his neck and poured a chemical on him. But prosecutors say Smollett orchestrated the incident and paid two men $3,500 to stage the attack, which he denies.
Abel Osundairo, one of the brothers, spoke about his own acting career and said he worked as an extra for Spike Lee's 2015 film "Chi-Raq" and regularly appeared as an extra on Smollett's former production "Empire."
"We became very fine friends," Osundairo said of Smollett. "I would contact him my brother."

Authorities opened an investigation into the attack, but in February of that year, police charged Smollett with filing a fake police report, alleging he had staged the assault.
He faced a total of six charges, each referring to distinct instances in which he was accused of lying to police. He was found guilty of five of the six charges, essence that the last one had not been proven in court.
At trial, jurors heard from brothers Abimbola and Olabinjo Osundairo, who said Smollett had orchestrated the attack himself and paid them $3,500 (£2,600) to carry it out.
Smollett said the cheque was for a meal and workout plan from Abimbola, a ally and an extra on Empire, a TV drama about a hip hop dynasty. Asked by his defence lawyer if he gave the man payment for the alleged scheme, Smollett replied: "Never."
He also testified that he and Abimbola were involved in a sexual relationship before the alleged attack.
Special prosecutor Dan Webb asked the performer repeatedly about a "hoax" attack. Each time, Smollett denied that was the case.
